Austria - The Administrative CourtMore about the Government Institutions. The administrative courtThe Administrative Court, located in Vienna, is the court of final appeal for cases involving administrative agencies. The court's specific purpose is to determine whether an individual's rights have been violated by an administrative action or omission. Individuals can also appeal to this court if an administrative agency fails to grant a decision in a case. The Administrative Court may not rule on matters that come under the competence of the Constitutional Court. The Administrative Court is presided over by a court president who is assisted by a vice president and several other court officers. Appointments to the court are made by the federal president on the recommendation of the cabinet. Prerequisites for appointment are completion of law and political science studies and ten years of experience in a related field. At least onethird of the court's members must be qualified judges, and at least one-fourth must come from the provinces, preferably from civil service positions. Panels of three, five, or nine judges sit in court at any one time, depending on the importance of the case. |
